ASEAN Arbitration Day 2026 | Opening Remarks by Chief Justice Sundaresh Menon

The ASEAN Arbitration Day 2026, co-organised by the ASEAN Law Association of Thailand and the Thai Arbitration Institute (TAI) on 21 July 2026, opened with thought-provoking remarks by Chief Justice Sundaresh Menon of Singapore, who called for greater "Convergence" in arbitration law and judicial practice across ASEAN.

Chief Justice Menon emphasised that convergence is not about creating identical legal systems, but about developing a shared commitment to internationally recognised arbitration principles. By aligning domestic laws and judicial approaches with the New York Convention and the UNCITRAL Model Law, ASEAN jurisdictions can reduce forum shopping, discourage tactical litigation, facilitate the recognition and enforcement of arbitral awards, and strengthen confidence in the region as a trusted seat for international dispute resolution.

Importantly, he highlighted the vital role of domestic courts in safeguarding the integrity of the arbitral process. Courts should support, rather than undermine, arbitration by respecting party autonomy and the finality of arbitral awards, intervening only on the limited grounds recognised under international standards. In this context, he also pointed to the growing significance of doctrines such as transnational issue estoppel, which help prevent the relitigation of issues that have already been conclusively determined, thereby promoting consistency, efficiency, and certainty in cross-border dispute resolution.

To further advance this shared vision, Chief Justice Menon proposed the establishment of an ASEAN Arbitration Judges Forum—a platform for judges across the region to exchange best practices, strengthen judicial dialogue, and foster greater consistency in the interpretation and application of arbitration laws.

His remarks offered an inspiring vision of an ASEAN arbitration ecosystem built on judicial cooperation, legal convergence, and a collective commitment to the rule of law.
